Warranty claims and benefits

What is the normal warranty period?

Welche Leistungen erbringt der Garantiegeber?

2.1 The warranty extension applies to the device listed in the purchase receipt (including the original accessories already included in the scope of delivery).

2.2 Repair Costs

In the event of a warranty claim, the guarantor will reimburse the necessary repair costs for the affected device

  • material defects
  • Construction mistakes
  • Production mistakes

Repair costs include the cost of parts, labor and technician travel expenses.

The repair or replacement work will be carried out by technicians commissioned by the guarantor (or by technicians from the manufacturer).

2.3 Replacement Device

If a damage that is subject to compensation cannot be repaired economically within a period of generally 15 working days and if the functionality of the device is impaired, the warranty holder will receive a replacement device of the same type and quality instead of the repair costs.

2.4 There is no guarantee protection for:

  • Damage that does not impair the function of the insured device or its accessories, in particular scratches and damage to the paintwork or the frame,
  • Damage for which there are guarantee or warranty claims against the manufacturer,
  • Damage resulting from operational wear and tear, such as damage to rollers, belts,
  • Ball bearings, ropes, pulleys, pedals, pads, saddles, grip surfaces, brakes, springs, running decks,
  • running mats, chains, leather and felt brakes and batteries,
  • Damage caused by unprofessional repairs, interventions, except for the replacement of parts
  • was carried out on and after subsequent installations, conversions or upgrades or cleaning instructions from a technician,
  • Damage or malfunctions that can be remedied by cleaning the device (e.g. dirt),
  • Damage that does not occur directly on the device (consequential damage),
  • Damage caused intentionally
  • Damage to or caused by software, improper modification of the software, programming errors,
  • Computer viruses and damage to external data carriers,
  • Damage to retrofitted or newly purchased hardware that was not included in the original scope of delivery,
  • Damage caused directly or indirectly by external influences (e.g. theft, moisture, fire, water, damage caused by falling or falling as well as operating errors),
  • the cost of rental equipment.

2.5 The warranty holder must be resident in Germany, Austria, Denmark, the Netherlands, Belgium, Luxembourg, Liechtenstein or Switzerland at the time the warranty extension is purchased.

Services from this warranty extension can only be claimed and provided in the countries mentioned.

What is to be observed during and after the occurrence of a guarantee claim, which contractual obligations to cooperate (obligations) exist and what are the consequences of violating these obligations to cooperate?

In order for the guarantor to be able to check the performance requirements, the following obligations apply during and after a guarantee case:

3.1 The guarantee case must be reported to the guarantor within 14 days of becoming known by telephone or in writing, stating the invoice number and serial number of the device.

3.2 After the occurrence of the guarantee case, the guarantee holder must keep the damage as low as possible.

3.3 If the warranty holder sells the device, the guarantor must be informed. The warranty protection for the device ends on the date of sale. However, the purchaser can apply to the guarantor within one month of purchasing the device to overwrite the warranty extension on him. If one of these existing obligations is violated, significant legal disadvantages can result. The following applies:

If the obligations are intentionally violated, the entitlement to benefits is lost.

In the event of a grossly negligent breach, the guarantor is entitled to reduce the benefits in a reasonable proportion to the severity of the fault. If the guarantee holder has proven that the breach of obligation was not due to gross negligence, the claim for benefits remains.

If an obligation is breached fraudulently, the entitlement to benefits is also lost.

To whom and when does the guarantor provide the services?

4.1 In the event of damage, the guarantee holder can assert his rights under these conditions directly and in his own name against the guarantor.

4.2 The guarantee case is to be checked by the guarantor as quickly as possible and the services are to be provided within approx. 15 working days after notification of the damage by the guarantor.

Protection and payment

When does the guarantee protection start?

The guarantee protection exists as soon as the guarantee extension has been purchased by the guarantee holder. At the earliest, however, after the manufacturer's guarantee and the statutory warranty have expired.

What does the guarantee holder have to consider when paying the invoice?

6.1. The invoice payment is to be made together with the purchase of the device using the payment method selected at the time of purchase.

6.2. The invoiced amount includes the statutory VAT.

6.3 If the amount has not yet been paid when a guarantee case occurs, there is no entitlement to the service.

However, there is an obligation to perform if it can be proven to the guarantor that the guarantee recipient is not responsible for the non-payment. c

Wann endet die Garantie?

7.1 Die Garantieverlängerung endet nach Ablauf der beim Kauf ausgewählten Laufzeit. In der Regel sind dies 3 Jahre.

7.2 The guarantee extension can be revoked by the guarantee holder in writing by e-mail, fax or post 14 days after purchase. The revocation form, which is available on the guarantor's website, can also be used for the revocation. The address details of the guarantor can be found on the first page of this form.

Sending the revocation in good time (postmark) is sufficient to meet the deadline.

What if I return or exchange the device?

8.1 If the purchase of the device included in the warranty extension is canceled within the statutory warranty, the warranty extension will also be terminated. The purchase will be reversed.

8.2 If the insured device is returned within the framework of an existing right of cancellation, the warranty extension will also be terminated. The purchase will be reversed.

8.3 If the damaged device is replaced with a new device of the same type and quality within the scope of the statutory warranty, the warranty extension is transferred to the new device.

Further regulations

Which law applies and where can claims be asserted in court?

 

9.1 The law of the country in which the purchase of the extended guarantee was processed applies to the extended guarantee. The law of the Federal Republic of Germany applies to online purchases.

9.2 If the guarantee holder is of the opinion that the guarantor has wrongly refused a service, he can have the decision reviewed by the court responsible for his place of residence. If the guarantor relocates his place of residence to a country outside the European Union or a state party to the Agreement on the European Economic Area, he can only turn to the court responsible for the guarantor's registered office.
